New effort being made for bail before assault, shooting trial

A 41-year-old Lethbridge man who was denied bail last April in relation to an assault and shooting earlier this year, will make another attempt to gain his freedom while he waits to stand trial.
Robert Duane Vincent was denied bail on April 21, despite assurances by his lawyer he could safely be released on certain terms and conditions, including house arrest.
Vincent, whose matter was spoken to in Lethbridge Court of King’s Bench last week, is scheduled to return to court Oct. 18 for a detention review, where his lawyer will try to convince a higher court judge to release his client from remand custody pending trial.
Vincent, who is in custody at the Lethbridge Correctional Centre, is charged with uttering threats to cause death or bodily harm, aggravated assault, assault with a weapon, assaulting/choking, theft of a vehicle, discharge a firearm with intent to injure, use of a firearm while committing an offence, careless use/storage of a firearm, pointing a firearm, unauthorized possession of a firearm, knowingly possessing an unauthorized firearm, possession of a firearm while prohibited, robbery with a firearm, possession of a weapon for a dangerous purpose, and mischief causing damage.
Lethbridge police reported that at about 6:26 a.m. on March 20 they responded to a 911 call that a man had been assaulted in his home on Rutgers Crescent West. The victim was taken to the hospital and treated for a gunshot wound.
Investigators determined the 54-year-old victim confronted his ex-girlfriend and another man, and following a brief verbal exchange was shot by the woman and physically assaulted by the man. The two assailants then fled in the victim’s truck. The truck was recovered a short distance away, and two suspects were arrested without incident later in day. Police also seized a firearm.
Vincent pleaded not guilty to his charges Aug. 15, and elected to have a trial in Alberta Court of Justice.
Co-accused, 38-year-old Kristina Hatcher, is charged with aggravated assault, assault with a weapon, assault/choking, theft of a vehicle, discharging a firearm with intent to injure, use of a firearm while committing an offence, careless use/storage of a firearm, pointing a firearm, unauthorized possession of a firearm, possession of a firearm knowing possession is unauthorized, robbery with a firearm, possession of a weapon for a dangerous purpose, and uttering threats to cause death or bodily harm.
During a court hearing last week, Calgary lawyer John Oman said Hatcher, who pleaded not guilty last month to her charges, will require a two-day trial. She is scheduled for a pre-trial conference Oct. 3 to discuss the trial, during which trial dates may be set and announced in court the following week.
