Local church part of constitutional challenge trial over public health orders

A constitutional challenge to Alberta’s pandemic health measures that includes a Medicine Hat church is set to begin today in Calgary.

Heights Baptist Church on the Southwest Hill is one of five parties challenging that orders of the chief medical officer of health to limit capacity and require indoor masks to stem the spread of the coronavirus were contrary to the Alberta Bill of Rights and limit Canadian Charter of Rights and Freedoms in an unjustifiable way.

The application was filed in December 2020, at which time a request of an injunction was denied.

A scheduled 10-day hearing is set to start this morning in Calgary Court of Queen’s Bench.

Also named as respondents are three individuals and the Northside Baptist Church, located in northeast Calgary. They are represented by the Rath and Company law firm and the Justice Centre of Constitutional Freedom.
