A Hatter who fled from police while throwing away packages of heroin and marijuana received a sentence of 35 days time served.
Jason Baynham pled down from two counts of possession for the purpose of trafficking to simple possession Tuesday at the Medicine Hat Courthouse for an incident that kicked off following an attempted early-morning traffic stop by police.
Facts read into court allege that on April 10 at 1:47 a.m., a police officer noticed a vehicle speed up once it passed the police cruiser, then failing to signal when it made a turn. The officer attempted to pull the vehicle over but it fled. The vehicle was successfully located eight minutes later, coming out of an alleyway, and pulled over by the officer who asked the driver — Baynham — for documents.
Baynham appeared to be impaired to the officer, and proceeded to throw his phone and 6.8 grams of marijuana on to the trunk of the car, then fled.
As he fled, Baynham started throwing items away from him, including separate bags 0.7 grams of heroin, 0.25 grams of heroin. 0.09 grams of heroin, 0.5 grams of heroin, and 1.55 grams of marijuana.
Once arrested, 4.35 grams of meth was found on his person, while a digital scale was found in the vehicle.
Defence counsel told the court joint submission comes due to problems the Crown had with its case. The accused has substance abuse issues he is trying to work through, said defence.
