90 days, time served for drug trafficking charge

It was 90 days, time served for a 35-year-old man arrested on a drug trafficking charge in March.

Jesse James Summers pled guilty Monday at the Medicine Hat Courthouse to one count of trafficking, as well as breaching the strict bail conditions he was required to follow after being arrested in November 2016 on charges of kidnapping, robbery and assault.

The trafficking incident stems back to March 6 of this year, when an undercover officer used a confiscated unlocked cell phone from another man to continue a conversation with Summers. In this conversation, Summers offered to sell the officer methamphetamine.

Drug trafficking sentences have a starting point of three years, that can go up or down depending on circumstances, the 90 days joint submission is due to charter issues, and issues the case would face at trial, the Court heard.

The sentence is considered time served, due to time spent in custody.

Summers remains in custody though. Due to his arrest on the trafficking charge, the provincial Crown is seeking to revoke the bail he was granted granted in February on the kidnapping, robbery and assault charges.

At the time, Summers had been granted release on a $1,000 no-cash bail, with conditions of house arrest, residing at a specific address, and attending a drug treatment centre — breach charges he also pled guilty to on Monday.

Summers will next appear in court on Aug. 30 for the new bail hearing.
