Assault and thefts lead to jail sentence

The phrase kicking someone who is down was never meant to be taken literally, but Kirby Judd Mills did.
Normally the phrase means to criticize, exploit or insult someone who has already suffered a setback or is in a vulnerable position, but Mills literally kicked a woman who was on the ground.
On June 23, 2020 police received a 911 call about two women who were fighting near a southside apartment building. The fight was consensual, but while one of the combatants was on the ground, Mills kicked her while she was down.
Mills, 29, pleaded guilty Wednesday in Lethbridge provincial court to one count of assault, and was sentenced to 30 days in jail.
Mills, who has a criminal record that includes convictions for assault and property related offences, also pleaded guilty to three counts of theft under $5,000, and was sentenced to 15 days on each, to run concurrently with the 30-day sentence.
Mills was arrested July 2, 2020 during a disturbance in Galt Gardens. When police searched him they found identification cards that had previously been reported stolen.
A month earlier Mills was in Galt Gardens when he asked a man to use his cellphone. When the man allowed him to use it, Mills took off on a bike. Although the victim needs a walker to get around, he attempted to follow Mills, who eventually stopped and engaged in a confrontation with his pursuer.
Then on March 9 of this year Mills stole some items from the Sexxxy Kitty store on the northside. He was identified through video surveillance.
Although sentenced to one month in jail, Mills was given credit for time already spent in jail since his arrest last month, effectively concluding his sentence. He will remain in custody, however, and returns to court on Nov. 2 to deal with additional charges.
