Fired CAO sues city, mayor for more than $1.3 million

Former city manager Ann Mitchell has filed lawsuits against the City of Medicine Hat and Mayor Linnsie Clark.

CBC News reported Tuesday that the total value of the compensation sought in the two lawsuits tops $1.3 million.

The lawsuit against the city is alleging wrongful dismissal. The lawsuit against Clark is claiming defamation and contract interference. Neither lawsuit has been tested in court.

Mitchell is seeking $165,000 for pay in lieu of notice and $300,000 in aggravated damages for the manner of dismissal from the city for a combined $465,000.

She is suing Clark for $797,000 for interference with contractual relations and $100,000 for damage to reputation and defamation.

“The City is aware of the two lawsuits that have been filed and intends to submit a Statement of Defence in each matter, disputing the allegations against the City and Mayor Clark,” wrote a city representative in a statement to the News.

The city spokesperson said an extension of time to file statements of defence has been granted by the plaintiff’s counsel in both matters.

Mitchell was fired by city council in October after being placed on leave in July. Council cited respectful workplace policy as the cause for her termination.

A dispute between Clark and Mitchell began in August 2023 and led to a council decision to sanction Clark from her duties. The sanctions were dropped following a judicial review, but the breach of code of conduct by the mayor was upheld.

The conflict between Clark and Mitchell also prompted a provincial audit, which found the working environment at city hall to be “untenable.”

Mitchell announced on social media Tuesday afternoon that she has been hired by Lac Ste. Anne County, west of Edmonton, as its new chief administrative officer. A county release states she has been hired on a five-year term.
