Accused seeks release alleging “fake” charges

A Coaldale man who insists his charges are fake and he should be released from custody, will be back in court next month after his lawyer has had an opportunity to receive disclosure from the Crown’s office.
The matter for Cody Gregory Fleming was in Lethbridge provincial court twice this week, but simply adjourned both times after brief hearings. On Tuesday Lethbridge lawyer Miranda Hlady said Fleming wanted to speak to his charges, but she was informed there wasn’t time because of the large number of files in court that day. The Crown prosecutor added he would need more time to address the matter, especially if the accused wants to discuss resolving his charges.
The matter was adjourned for one day, but on Wednesday defence simply asked for another adjournment to obtain disclosure.
Fleming faces numerous charges, including threats to cause death or bodily harm, resisting a peace officer, criminal harassment, causing a disturbance by screaming, assaulting a peace officer, mischief and multiple counts of failing to comply with release conditions.
He was granted bail last November, but was back in custody Feb. 5 for allegedly breaching his release order the previous month. He was denied bail following a bail hearing last week, and the matter adjourned for him to contact Legal Aid and have a lawyer appointed.
During a brief appearance in court last Friday, he again insisted on being released, despite being denied bail earlier in the week.
“I want this over with,” Fleming demanded. “These aren’t real charges. I was never read my Miranda rights.”
The case is scheduled to return to court Tuesday.
