Local man gets two years for possessing, distributing child porn

A Medicine Hat man who used the Internet to access and distribute child pornography was sentenced Wednesday to two years in jail.

Dane Frerichs, 30, entered guilty pleas at the Medicine Hat Provincial Court to possessing and distributing child pornography for incidents that stem back to April 2014.

Investigation into Frerichs began in March 2016, when Microsoft contacted national authorities in Canada to report that a user of the online messaging/video service Skype had uploaded depictions of child pornography to the account.

Authorities were eventually able to track the user to Frerichs’ residence. A search warrant was executed on July 13, 2016, and Frerichs was charged. Some 5,000 images and more than 400 movies depicting child pornography were found on electronic devices that belonged to Frerichs.

The court heard that soon after his arrest, Frerichs had sought counselling of his own accord. Defence counsel Robert Robbenhaar stated that this has led Frerichs to have insight into his actions and the harm he’s done.”

The sentence was a joint submission by both Crown and defence.

The sentence is on the low range, said the Crown prosecutor but “in this particular case, considering Mr. Frerichs’ attempts to obtain counselling, this would be helpful in protecting the public.”

Also considered for the sentence is that Frerichs was fully co-operative with police — including providing passwords for his electronic devices— and that he has entered what’s considered an early guilty plea.

Frerichs has no previous criminal record.

Alongside the two years of jail, Frerichs will serve two years of probation where he will be required to attend counselling, including psychological, sexual deviation and exploitation.

He will also be on the sex offender registry list for life.

There will be a five-year restriction surrounding his interaction with those under the age of 16, including supervision requirements, and restrictions to his use of the Internet.
